Right of withdrawal for consumers

Consumers are entitled to the right of withdrawal in accordance with the following provisions, whereas a consumer is any natural person who concludes a legal transaction for a purpose which can be attributed neither to a commercial nor to a self-employed occupational activity.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reasons. The withdrawal period is fourteen days from the day in which you or a third party, other than the carrier and indicated by the consumer have/has acquired the material possession of the products. In order to exercise your right of withdrawal, you have to inform us (Heike Sostmann, - Spiegel-Shop -, Holländische Str. 207b, 34127 Kassel, Phone number: 0561-220798-0, Fax number: 0561-220798-29, E-mail: info@myspiegel.de) on the basis of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. Therefor you can use, whereas it is not required, the model withdrawal form, which is available below. In compliance with the withdrawal period, it is sufficient that you send the notification concerning the exercise of the right of withdrawal before expiry of the withdrawal period.

Consequences of withdrawal

If you withdraw from this contract, we shall repay you all the amounts received from you, including costs of delivery (with the exception of additional costs resulting from choosing a different type of delivery from the advantageous standard delivery, which we offered) without delay and at the latest within fourteen days from the day, on which we received the notification of your withdrawal from this contract. For this reimbursement we shall use the same means of payment, which you use upon the initial transaction, unless we explicitly agreed with you otherwise; under no circumstances you will be charged fees for this reimbursement.

We pick up the products on our expenses.

You will have to pay for any diminished value of the products only if this loss in value is resulting from the handling other than what is necessary to ascertain the nature and functioning of the products.

Exclusion, respectively premature lapse of the right of withdrawal

The right of withdrawal does not apply in the case of contracts

• for the delivery of products, which have been prefabricated and produced according to an individualized choice or distinctive character of the consumer or which were clearly tailored to the personal requirements of the consumer;
• for the delivery of sealed products, which for reasons of public health or of hygiene are not suited to be returned, if the seal was removed after delivery;
• for the delivery of products, which have been mixed after the delivery with other items because of their characteristics.

The right of withdrawal lapse prematurely in case of contracts

• for the delivery of sealed products, which for reasons of public health or of hygiene are not suited to be returned, if the seal was removed after delivery;
• for the delivery of products, which have been mixed after the delivery with other items because of their characteristics;
• for the delivery of sealed sound and video recordings or computer software, which were unsealed after delivery.
